The draft Resolution of the Government of the Republic of Kazakhstan "On invalidation of the Decree of the Government of the Republic of Kazakhstan dated June 28, 2018 No. 391 "On approval of the Rules for recognizing waste generated as a result of the destruction of goods unsuitable for their further Commercial Use" (hereinafter – the Draft Resolution) was developed pursuant to paragraph 210 of the Decree of the Prime Minister of the Republic of Kazakhstan No. 90-r dated 01.06.2023, due to non-compliance with regulatory legal acts of a higher level, as part of ongoing decentralization measures to implement the Law of the Republic of Kazakhstan dated March 16, 2023 "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on administrative reform of the Republic of Kazakhstan".

In this connection, the Ministry of Finance of the Republic of Kazakhstan was instructed to develop a draft order "On approval of the Rules for recognizing waste generated as a result of the destruction of goods unsuitable for their further commercial use", providing for the Decree of the Government of the Republic of Kazakhstan on invalidation of the Decree of the Government of the Republic of Kazakhstan dated June 28, 2018 No. 391 "On approval of the Rules for recognizing waste generated in as a result of the destruction of goods unsuitable for their further commercial use."

The purpose of the Draft Resolution is to invalidate the Decree of the Government of the Republic of Kazakhstan No. 391 dated June 28, 2018 and the amendments made to it, in connection with the decentralization of powers between the levels of public administration in terms of transferring functions from the Government level to the authorized body.
