From February 8, 2019, the Rules for writing off the amount of penalties and fines subject to payment of the amount of debts shall be applicable

 

“Rules for writing off the amount of penalties and fines subject to payment of the amount of debts” (hereinafter - the Rules) were approved by the Order of the Minister of Finance of the Republic of Kazakhstan No. 39 dated January 21, 2019.

These Rules are registered with the Ministry of Justice of the Republic of Kazakhstan on January 24, 2019 under No. 18233 and published on January 28, 2019 in the Reference Control Bank of Regulatory Legal Acts of the RK in an electronic form.

The rules will be applicable upon expiration of ten calendar days after the day of its first official publication, i.e. from February 8, 2019.

As is known, from January 1, 2019 the Law providing for granting of a tax amnesty for small and medium-sized businesses, entered into force.

As of January 25, 2019, 25,769 taxpayers have already repaid the amount of debts, which they had as of October 1, 2018, for a total amount of 5.5 billion tenge.

According to the approved writing-off procedure, such taxpayers will be charged penalties in the total amount of 1.0 billion tenge and fines in the amount of 37.0 million tenge.

From which, the amount of debts fully repaid (for all types of taxes) as of October 1, 2018 - 24,270 taxpayers, the amount of repaid debts - 4.8 billion tenge.

For such taxpayers the penalties totaling 0.6 billion tenge and fines amounting to 20.3 million tenge

will be written off.

We would like to remind that according to preliminary data, 90,077 entities of medium-sized and small business (31,210 legal entities and 58,867 individual entrepreneurs), having tax debts in the amount of 340.6 billion tenge as of October 1, 2018, are included in the amnesty.

The total amount of penalties to be written off is 122.9 billion tenge, fines - 7.3 billion tenge, which will be written off subject to payment of the principal debt in the amount of 210.4 billion tenge.

In addition, the penalties accrued from October 1, 2018 until the date of payment of the principal debt will also be written off.

The amnesty does not extend to large taxpayers to be monitored, subsoil users (except for the subsoil users who are those solely due to their right to extract groundwater, therapeutic mud), manufacturers of excisable goods.

In order to be included in the amnesty, taxpayers do not need to apply anywhere, the state revenue authorities will monitor the status of personal accounts on a daily basis and as soon as the principal debt is paid, they will make appropriate decisions on writing-off within three working days.

The taxpayers can clarify the amount of the principal debt, the amount of fines, by getting an extract from the personal account in the “Taxpayer's Cabinet” web application.

They can also find out information about tax debts on the Committee’s Internet resource www.kgd.gov.kz  and use on the “Electronic government” portal the e-service “Information on absence (presence) of tax debts”, which allows them to get relevant information online on the presence/absence of tax debts using the taxpayer’s IIN/BIN.

The exceptions are the taxpayers who are in the rehabilitation procedure or who are provided tax deferral for paying taxes.

If such taxpayers wish to be included in the tax amnesty, they should send a proper application to the state revenue authority and prepay the principal amount of the taxes.

In addition, the taxpayers going through a rehabilitation procedure should make changes to the rehabilitation plan, reconcile the changes with the meeting of creditors and approve them by the court.
